By accessing, registering, or utilizing the Rishi Homoeo Clinic online platform ("Platform") to book an appointment, you explicitly agree to comply with and be legally bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

1. Healthcare & Medical Emergency Disclaimer

Not for Emergencies: This Platform is strictly for scheduling standard homoeopathic consultations. It is NOT intended for medical emergencies, critical care, or life-threatening situations. In case of a medical emergency, immediately visit the nearest hospital.

Booking an appointment does not establish an immediate doctor-patient relationship until the physical consultation occurs. Dr. Rishi Kumar Agrawal provides homoeopathic treatments; outcomes vary by individual, and no absolute guarantees of cure are promised.

2. Service Scope & Right of Refusal

Successful submission of the booking form and payment guarantees a slot reservation, subject to clinic availability. However, the Clinic reserves the absolute right to:

• Delay, postpone, or cancel appointments based on the Doctor's availability or operational exigencies.
• Block, ban, or refuse service to any user who provides false information, exhibits abusive behavior, or misuses the booking system.

3. Payments, Platform Fees & Medicines

The fees collected on this Platform constitute a Booking/Platform Fee only, reserving your time slot. Charges for prescribed medicines are entirely separate and must be paid in-person at the clinic.

4. Strict Refund & Cancellation Policy

By making a payment on this Platform, you agree to our strict financial policies:

• Patient-Initiated Cancellations: If you (the patient) cancel an appointment "after 9pm on the day before appointment", fail to show up, or arrive late, the booking fee is strictly non-refundable, If a booking is cancelled before 9pm, 50% amount is refunded. For exact and more details you can see it just before paying the fees on the booking page itself.
• Clinic-Initiated Cancellations: If Dr. Rishi Kumar Agrawal or the Clinic administration cancels your appointment (e.g., due to an emergency), a Full Refund of the online amount paid will be initiated automatically. Please allow 7 to 14 business days for the amount to reflect in your original payment method via Razorpay.

5. Data Accuracy & User Liability

You are solely responsible for providing accurate contact data (Email/Phone). We bear absolutely no liability for missed appointments or unreceived refunds arising from our inability to contact you due to incorrectly entered information.

6. Limitation of Liability & Indemnification

The Platform is provided on an "As-Is" and "As-Available" basis.

• Data Breach Waiver: You explicitly waive any right to sue or hold liable the Clinic, Dr. Rishi Kumar Agrawal, or the Website Developer(s) in the rare event of a malicious cyber-attack, server compromise, or accidental data leak.
• Total Indemnification: You agree to fully defend, indemnify, and hold harmless the Clinic and its developers from any claims, damages, or losses arising out of your use of the Website, failed payment gateway transactions, or reliance on the scheduling system.

7. Force Majeure

We shall not be held liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including natural disasters, internet outages, telecommunication failures, or third-party payment gateway downtime.

8. Governing Law & Jurisdiction

These Terms shall be interpreted and governed exclusively in accordance with the laws of the Republic of India. Any legal disputes arising out of these Terms, medical consultations, or the handling of user data shall be subject to the absolute and exclusive jurisdiction of the competent courts located in Etawah, Uttar Pradesh, India.
